Chapter 7 and 13 Bankruptcy Filings in Florida

Chapter 7 Bankruptcy

If you have little or no assets, a Chapter 7 bankruptcy is your best option. It is a liquidation of all your nonexempt assets. You are able to keep certain assets such as one vehicle and household goods and furnishings up to a certain amount. In some cases, the trustee may allow you to buy back some nonexempt assets.

When we file your bankruptcy petition, the automatic stay puts an immediate stop to all collection activity. Collection calls, letters and garnishments will be a thing of the past. Once your petition is approved by the trustee and court, all of your unsecured debt will be wiped away. If you do not qualify for a Chapter 7 bankruptcy, a Chapter 13 filing is still an option.

Chapter 13 Bankruptcy

If you own too many assets or your income is over a certain limit, or if you have IRS debt pending, you can still seek protection through a Chapter 13 filing. Unlike a Chapter 7, your debt will be reorganized and paid back over a period of time. This allows you to manage your debt and maintain your assets while being free from collection activity. A Chapter 13 will also reinstate the mortgage on your home if you have fallen behind on payments. It will also reduce the debt that you owe to the IRS.
